This verdict should immediatley be set aside and the child turned over to the father. Where did the twelve year old get the idea of posting pictures of herself unto adult websites? Lets be honest here the old myth of women being the only real parent rears it's ugly head again. A father doesn't have a chance of being a parent, (see Canadian Statistics on men and divorce 2007)even when he has custody of the child. I am sure the child did not initiate this case and that the mother was the one to exploite/create this situation. Now she can wave her court order around and tell her twelve year old and the other children in her husband's custody what a bad man their father is. As for Judge Suzanne Tessier she should have her other cases involving children and parents investigated for incompentence on her part. Finally, has Justice Suzanne Tessier ever been divorced, like an elephant an ex wife never forgets.

Do you have any support for your contention that this exemplifies "judicial 'human rights' activism"?

The National Post article on this story suggests that court's decision is in keeping with the wishes of the child's mother.

While the father has full legal custody of the girl ("pending a further court decision," according to the Post's rendering of the words of the child's lawyer), she's been living with her mother since May. There is dispute over whether the child "ran away" to her mother's or whether the father kicked her out.

So we have a situation where the parents disagree and where the father is alleged to have kicked the child out of the house (which, if true, is an abdication of his responsibilities as a parent). According to the Ottawa Citizen (article link), the child's lawyer said that the fact that the girl is now living with her mother was a factor in the judge's ruling.

To me, this case is far more complex than the one-sided article you linked to (which quotes the father's lawyer but not that of the child).
